New Regulations for Small Business Owners

Time was, you could just hang up a shingle and call yourself a business. As long as you didn’t shoot anyone, you were pretty much left alone. Not so any more. A glut of federal and state regulations have come into being, many just over the past few years, and many apply to small businesses. These regulations are meant to accomplish any one of several social goods, such as protecting an individual’s privacy and preventing identity theft, preventing corporate financial scandals, or lastly, or so it would seem, just to annoy small businesspeople by increasing their paperwork burden. Fortunately, if you understand these regulations, complying doesn’t have to be too difficult or expensive.

If you have a publicly-held company, you’ll have to comply with the Sarbanes-Oxley Act, which sets technological standards and reporting requirements for how companies handle their financial reporting. Passed in response to the recent wave of corporate scandals, fiscal mismanagement and outright theft, Sarbanes-Oxley puts in place a set of requirements for establishing internal controls that ensure the integrity of a company’s financial data. Although the requirements are generally the same for companies of all sizes, smaller companies have been granted some flexibility in terms of longer timeframes to become compliant. This Act calls for, among other things, security-related solutions to be put into place to regulate access to financial data, provide an audit trail, and generate detailed reports for the government. The good news is, if you already follow best practices in security, you’re already more than halfway there.

If you are in the healthcare industry, whether you are a healthcare provider, pharmacy, or a data processing agency serving the healthcare industry, you’ll have to comply with the Health Insurance Portability and Accountability Act (HIPAA). HIPAA calls for any company that handles private patient data to guarantee that it is secure and protected against unauthorized access. If your company handles healthcare information of any sort, for any reason, you will have to take technological steps to ensure that it is secure through measures such as encryption, strong two-factor authentication, and adequate firewalling.

And if you’re in California, or if any of your customers are in California, you’ll have to comply with SB 1386 (the California Information Practice Act). This law requires that your company provide notice to customers whenever any technological hack, or other attack has occurred and caused personal information to be exposed and vulnerable to theft. Meant to safeguard against identity theft, this state law also applies to any subcontractors of companies that maintain information about California residents. This particular law is ground-breaking, since although it is on paper just a California law, it has, in reality, become a federal law. California is the largest state, population-wise, in the U.S., and any mid-size company and many smaller ones have at least a few customers in California, regardless of where the company is actually located. If, for example, your company is in Maine, but your mail order division sold some products to someone in California, you must comply. Compliance simply means that if your network is attacked, you must notify your customers. Although this can be done individually, most companies actually make notification on their Web sites, or through issuing a public press release.

The Visa Cardholder Information Security Program (CISP) isn’t a state or federal law, but a mandate from VISA USA created to protect cardholder data. It calls on all vendors who accept credit card payments to adhere to a higher standard of information security for the purpose of guarding against identity theft. CISP calls on vendors to implement standard security measures such as firewalls, anti-virus software, and strong authentication to regulate who has access to customer credit card data. Visa also has set forth a set of best practices. Compliance is easy, and involves adhering to the Payment Card Industry Data Security Standard which includes a call for implementing standard security technology, restricting access, and encrypting the transmission of any cardholder data.

Executive Coaching – Finding a Coach and Understanding the Process

Nobody in business can fail to have noticed the recent rise in the number of coaches and consultants offering their services. But how do you go about finding a coach who will give you a return on your investment? Executive coaching might be an option for you if you are running your own business or are in an employed management role, and have aspirations to achieve more.

I would advise you to initially identity an executive coach through recommendation, or by conducting your own research on the web or in trade publications, and then request a free session to ask questions and find out more about them. Most coaches will give you some time without charge at the outset to discuss what your objectives are in beginning coaching, and to establish whether there is sufficient compatibility between you.

If there does not seem to be a connection, or if the coach feels someone else can help you more, they will refer you on to someone who is more appropriate. Only commit if you feel excited and relaxed about working with that individual – if there are any doubts, go with your intuition. We are all different and what works for your friend or colleague may not work as well for you.

You will be asked to commit to an agreed period of coaching, not to protect the coach’s income, but to give the process a fair chance of taking effect. The period will vary from coach to coach, and will depend to some extent on what you are wishing to achieve. You may find you are getting cold feet once you have committed to coaching, and feeling nervous or negative about the outcome. This is entirely natural and will disappear once you have embarked on your regular sessions.

You and your coach will decide on specific goals to be attained, but don’t worry if you have none at the start of coaching, as they will soon become evident as you think about what you want to achieve in life. Often our goals shift anyway, as we learn more about ourselves and what we want, rather than what society wants for us. You will be expected to spend time between sessions on accomplishing the goals you have set with your coach and on reporting back to them so they are prepared for the next session.

An executive coach is a sounding board who allows you to understand your own strengths and realise where your comfort zone ends and how to move beyond it. It is like having a conversation with a friend who has only your interests at heart and who can contribute to your development in a completely detached way. A friend who has no emotional investment in you staying the same and will be purely delighted, and not at all threatened, if you start to achieve more of your goals.

As a coaching client, you will be required to be open and honest with your coach and tell them what you feel is and is not working. In order for executive coaching to really make a difference to you, you must be willing to look at yourself as objectively as possible and not become defensive or upset if it becomes apparent that some of your current behaviour is not the best response to the situation you find yourself in.

You will need to be able to change your behaviour in some circumstances to see if an alternative works better. You should also be prepared for changes throughout your life and not just at work – we do not operate in boxes, and a change in one area of your life will have a knock-on effect in others. You may well find family and friends remarking on the changes in you.

Try to be as open-minded as you can about executive coaching and what it may bring you. Many people are pleasantly surprised by the fundamental improvements it can help bring about at work and home.

When I learned about article writing as a way to generate web site traffic, I was intrigued. Unfortunately, it took me several hours to write that first article for my backpacking web site, and another two hours to submit it to several article directories. I still liked the idea, but it seemed like a lot of work for the results. There had to be a better way.

Today, I often write a new article in less than thirty minutes. Then I submit it to fourteen article directories in about twenty minutes. This means six times as much output in the same time, which means six times as much traffic generated, which means six times as much money made for the same effort. It seems very worthwhile now.

Article Writing Efficiency

First, I learned to write shorter articles. Attention spans online are short, and you want to keep the reader reading to the end – where the link to your site is. You also want the article to be used on other sites, and many webmasters won’t use long articles. These are two good reasons to keep it short. Of course this means less time writing too.

I soon learned to identify the essential information quickly. In fact, articles like “Free Web Site Traffic – Seven Ways,” get right to the point and are basically a list with a quick explanation of each item. They are easy to write quickly, and popular with readers.

The next important lesson I learned, was to keep a list of article directories on a file in the computer. I copy and paste an address into the browser for quick access to any of the twenty directories on my list. The addresses go straight to the submission page, or the login page. Links in your “favorites” list would work well too.

The most tedious part of the article writing process is the article submission forms. Some directories ask for descriptions, others don’t. Some allow HTML, and others don’t. To make this part go quickly, keep your articles organized in a Window’s Notepad file or something similar. Write the title, then a two or three sentence description, and then a list of three to six keywords that the article might be found by. Then write the article.

You may find it faster to have two versions prepared, one with HTML tags for things like subtitles and italicizing. Have an author’s resource box (like the one at the bottom of this page) prepared in two versions too – one with just the full URL of your web site, and the other with an active HTML link.

Now you can go quickly to the directories on your list, and copy and paste the proper elements in the proper parts of the form. If you have an auto-fill function on a Google or other toolbar, you can also enter name and e-mail address with a click.

Speed is the result, meaning more money for the time spent. To really make it efficient, you have to have a system. You can start with mine. Then look, and you’ll find even more ways to systematize your article writing.
